Chairman of Investigative Committee orders Central Office Commission to Khanty-Mansi Investigations Directorate

On 14 May 2014, a 23-year-old young woman was conspicuously killed in the city of Khanty-Mansiysk in front of several witnesses and her mother. The Khanty-Mansi Autonomous Area investigating bodies of the Russia’s Investigative Committee have launched a criminal investigation and charged Marif Mamedov with a crime under part 1 of article 105 of the RF Penal Code. At the investigators’ motion court has already ruled to remand the accused in custody.

It has been established, that a month before the killing, the young woman reported having been raped by Marif Mamedov. The check into the report was carried out by investigator of Khanty-Mansi inter-district investigations office Sharif Aripov, who then refused to open the case. His decision was recognized illegal and following an additional check a criminal investigation was started into the crime under paragraph “b” of part 2 of article 131 of the RF Penal Code (rape under the threat to be killed).

By now Aripov and his chief have been dismissed. Several other officials have been subject to disciplinary punishment.

Considering the fact that the rape criminal case could have saved the woman’s life if timely opened, Aripov is now under a pre-investigating check under article 293 of the RF Penal Code (negligence), following which it will be decided whether to start a criminal investigation.

The Chairman of the Russia’s Investigative Committee has sent to Khanty-Mansiysk the Central Office Commission to figure out the reasons of this outrageous fact of ignoring the woman’s report, who came to the investigator to seek protection. Such attitude is absolutely counter to that of the Chairman, who believes it necessary to study carefully and respond to each report and demands the same from his subordinates. The commission will also check whether the investigator’s decision was just a negligent act or he and his superiors had some other motives. Following the check of the Commission, tough legal assessment will be given to actions of all the officials of the Investigations Directorate and its senior officials, so that in future such facts do not repeat themselves in the practice of the Committee’s divisions.
