In St. Petersburg three employees of Waterville aqua park to face trial on charges of providing services not meeting safety requirements

The Saint-Petersburg Main Investigations Directorate of the Russia’s Investigative Committee finished investigating the criminal case against Waterville aqua park employees, namely, instructor Anton Khvostov, shift boss Alexey Belyayev and director of the aqua park Inna Podvalnaya. They are accused of an offense under paragraph “c” of part 2 of article 238 of the RF Penal Code (providing services not meeting safety requirements).

According to investigators, at about 5:00 pm, on May 20, 2014, a child was in the water park together with his parents. After the 4-year-old boy took off a lifejacket and gave it to his parents, they began putting it on the other child. At that moment the boy, who had been heading for the exit from the pool, went back, fell on a rung of the ladder and hit his head. He received a head injury and went underwater. The child’s father pulled him out of water immediately, and the safeguards of the facility administered first medical aid to the boy.

Investigators believe that Podvalnaya did not provide safe conditions for the visitors of the aqua park while Khvostov and Belyayev let the boy stay in water without a life jacket. Thus, Podvalnaya, Khvostov and Belyayev failed to meet the requirements for the operation of a water slide and their job responsibilities.

The criminal case has been promptly investigated and comprises 9 volumes. A few dozen witnesses have been questioned. A number of complex expert examinations have been carried out, including those conducted in Moscow.

Investigators have gathered enough evidence and the case with the approved indictment has been forwarded to court to be tried on the merits.
