In Tomsk Region former top managers of Siberian Chemical Complex and TVEL found guilty of commercial bribery

A court has recognized the evidence gathered by the Tomsk Region investigating bodies of the Russia’s Investigative Committee sufficient to convict a group of former top managers of OAO Siberian Chemical Complex (Open corp.) and OAO TVEL (Open corp.). They were found guilty of crimes under paragraphs “a” and “c” of part 4 of article 204 of the RF Penal Code (commercial bribery committed by a group of people in a previous concert for illegal actions).

The criminal investigation was launched on 22 June 2012, based on the materials of the search and investigating operations by the regional office of the Federal Security Service and with the assistance of internal security service of Rosatom state corporation. During the investigation four more criminal cases were opened and then joined to form a single proceeding.

The court and investigators have found that the former CEO of the Siberian Chemical Complex and two of its deputy directors in 2011 after a reducing bidding held by TVEL (Rosatom division) concluded with OOO International Center of Technologies and Trade, ZAO Bagomes and OOO ServisAtomTrans, which won the bidding, contracts on supply of coal for the needs of the Siberian Chemical Complex worth 557 million 200 thousand rubles each.

Starting from September 2011 the suppliers regularly undersupplied monthly amounts of coal or supplied coal that did not meet the requirements under the contracts. Under the preliminary agreement with the suppliers the accused acting in the commercial interests of the said companies illegally regularly received from them bribes in cash, which they then divided. Part of money they gave to a former executive director of the board for logistics of TVEL for him not to take any measures to break the said actions of the accused and eliminate breaches of suppliers’ obligations under the contracts. In all, the accused received over 18 million rubles in bribes.

Additionally, in 2012, former CEO of the Siberian Chemical Complex and one of his deputies illegally received from director of OOO Tomsky VtorCherMet and OOO Tomsky VtorTsvetMet a bribe of 4 million rubles for prolonging contracts on selling metal scrap and waste of ferrous and nonferrous metals and reduction of their cost.

The total sub of a commercial bribe was around 22.5 million rubles. The property of the accused worth in total around 300 million rubles was arrested during the investigation.

There are 37 volumes of files in the case. During the probe, the investigators questioned dozens of witnesses, fixed and ran 8 forensic analyses, including accounting and economic ones. It took over 6 months the accused and their lawyers to read the files of the case.

The court has sentenced Korotkevich to 7 years in prison and a fine of 120 million rubles, Yuri Kungurov – to 6 years and a fine of 100 million rubles, Leonid Romanenko – to 6.5 years and a fine of 100 million rubles, Timur Bukeykhanov – to 5 years and a fine of 100 million rubles. Romanenko and Bukeykhanov were detained in the court room after the sentence had been pronounced.
