In Khakassia former minister of agriculture and rations to stand trial

Khakassia investigating bodies of the Russia’s Investigative Committee have finished investigating a criminal case against former Vice-Chairman of Khakassian Government – former Minister of Agriculture and Rations of Khakassia Ivan Vagner. He is charged with crimes under part 2 of article 285 of the RF Penal Code (abuse of authority by a person occupying a state position in a federal subject of the Russian Federation), article 289 (illegal participation in business activities), part 2 of article 286 (abuse of authority), part 3 of article 159.2 (fraud with payouts committed by a person using their official position on a large scale).

According to investigators, in the period between April 2009 and September 2014, Vagner while serving as Vice-Chairman of Khakassian Government –Minister of Agriculture and Rations of Khakassia used his authority against interests of his service namely by showing preference to a number of legal entities and farms owned by his close relatives or friends by giving orders to the Ministry of Agriculture and Rations of Khakassia to provide them with subsidies on preferential terms.

Over the period of his office the accused provided twenty affiliated legal entities and farms with budgets subsidies worth over 2 billion rubles which equals to almost half of 4.1 billion rubles of subsidies allocated for the Republic of Khakassia.

In addition, in the period between June 2011 and September 2014, Vagner personally organized allocation of over 41 million rubles in subsidies to Iyus-Agro (hereinafter the firm) on preferential terms.

This way, in 2013, over 10 million rubles in subsidies were fully paid to the firm on preferential terms, while one of the districts in the republic did not received subsidies worth over 2 million rubles to buy farming machines, over 1 million rubles to buy reproduction seeds, 450 thousand rubles to buy foundation seed stock, 41 thousand rubles to buy plant protection means, over 1 million rubles to pay off the loan interests to banks.

Besides, aware that OOO Baklayevskoye had farming machines and that in case they were alienated the subsidy had to be paid back within three years from the time of alienation, Vagner in the interests of Iyus-Agro decided to purchase OOO Baklayevskoye as a set of assets including its tractor and grain combine having no intention to pay back the subsidy allocated to buy the said machines. After the talks with the founder of Baklayevskoye he made fictitious documents stating that there was a contract of debt and a contract on purchase of seeds, by that he actually concluded the deal of purchasing the firm, including the tractor and grain combine causing the republic pecuniary damage of over 4 million rubles.

In addition, in June 2014, aware that his son-in-law had filed fictitious documents entitling to a social payout with the Ministry of Agriculture and Rations of Khakassia, Vagner gave an inferior official an order to calculate the social payout based on the documents filed and prepare a certificate providing the said social payout on construction of a house in rural area. As a result of Vagner’s actions budgets of all leverls suffered loss of over 800 thousand rubles.

At present the criminal case with the approved indictment has been sent to court to be tried on the merits.
