In Krasnodar Territory, three men found guilty of series of crimes including murder of Great Patriotic War veteran

A court has recognized the evidence gathered by the Krasnodar Territory Office of the Investigative Committee sufficient to convict three men. Radzhi Smailov and Nikolai Nikolayenko were found guilty of killing three elderly people aggravated by robbery and felonious assault under Part 2, items “a”, “c”, “g” and “h” of Article 105, Part 4, item “c” of Article 162 of the RF Penal Code. Nikolayenko was also found guilty of a robbery committed by a group of people in conspiracy in 2014 under Part 2, items “a” and “d” of Article 161, while Radzhi Smailov and his cousin Boris Smailov of open larceny of cash from a veteran committed un autumn 2013 under Part 2, items “a”, “c” and “d” of Article 161 of the RF Penal Code.

The court and investigators have established that in October 2015, Radzhi Smailov and Nikolai Nikolayenko assailed two elderly sisters in the town of Belorechenks. On the night of 18 October 2015, the men broke into the house of the sisters aged 76 and 78 in order to commit larceny and hit the women on the head and body with wooden sticks. The victims sustained brain injuries, skull cup and basal skull fractures and other injures and died on the spot. The perpetrators stole 30,000 rubles and took off.

The same men arrived to the house of 88-year-old Great Patriotic War rear laborer Valentin Zagornyan in Tolstoy Street in the town of Belorechensk on the night of 20 November 2015. They smashed a window and got inside the house. They beat the elderly man demanding that he gave them money. They searched the house and found some 40,000 rubles, which they took and fled. The veteran sustained a head trauma and other injuries. Despited medical aid he died.

Earlier, in October 2013, Smailov borthers had committed open larceny of money from the same elderly man. Then they had stolen from him 51,000 rubles.

In addition, Nikolayenko with two of his relations (convicted of the crime) robbed a man and stole from him 10,000 rubles in Aprli 2014 in the village of Besleneyevskaya, Mostovskoy District.

The investigators ran 30 expert examinations, including DNA, psychiatric, traceological and psychological ones and more than 100 investigative operations.

The court has sentenced Radzhi Smailov to 18 years plus 2 years of limited freedon, Nikolayenko to 17.5 years plus 2 years of limited freedom. Boris Smailov got 6 years plus 6 months of limited freedom. All three men are going to serve their time in a maximum-security correctional facility.
