On the instruction of the Chairman of the Investigative Committee of Russia, measures are being taken to further investigation of facts related to inadequate drug provision in Kaliningrad and Tomsk oblasts

Mr. Alexander Ivanovich Bastrykin, Chairman of the Investigative Committee of the Russian Federation, at a personal reception of citizens in July 2022, heard the problems of residents from Kaliningrad and Tomsk oblasts. The applicants, parents of disabled children, reported that they did not receive the full amount of medication prescribed by law. The specified information served as a pretext and basis for the decision to launch criminal cases against officials of the ministries of health of these regions on the offense of a crime prescribed in Part 1, Article 293 of the Criminal Code of the Russian Federation.

Without knowingly prejudging the guilt of specific officials, under preliminary investigation, it was planned to establish the circumstances of the incident in detail and objectively due to exclude risks to the life and health of citizens. However, the decisions made by Investigation were annulled by the supervisory authority, which did not see sufficient evidence of a significant violation of the rights and legitimate interests of the applicants. This conclusion of the lower prosecutors was supported by the Prosecutor General of the Russian Federation I.V. Krasnov, who denied the investigators' complaints.

At the same time, a real threat to the lives and health has been made, taking into account the specifics of the diseases, the fact of violation of the rights of citizens to the provision of vital medicines provided for by federal laws and international legal acts, is significant, regardless of whether interruptions in their issuance led to an actual deterioration in the condition of sick children.

Taking into account all mentioned above, and in view of the acute social significance of the issue of providing medicines and medical devices, on the motion of Mr. A.I. Bastrykin, Chairman of the Investigative Committee of Russia, the investigators repeatedly took decisions to launch criminal cases on the indicated above facts, which were again canceled by the deputies of the Prosecutor General of the Russian Federation on similar grounds.

At present, the said decisions have been again appealed by the investigators to the Prosecutor General of the Russian Federation. The position of the Investigative Committee remains the same - violations of the rights of citizens are subject to investigation and legal assessment.
