In the process of investigating a criminal case launched by the Central Investigations Directorate of the Russia’s Investigative Committee on the results of the check into facts showed in the documentary Anatomy of a Protest-2, Leonid Razvozzhayev is charged with a crime under part 1 of article 30 and part 1 of article 212 of the RF Criminal Code.
In addition, Sergey Udaltsov and his lawyer Violetta Volkova will be also summoned for charges on 26 October 2012 in the Central Investigations Directorate.
In connection with the claim by V. Volkova that she couldn’t get in the pre-trial prison to leonid Razvozzhayev we should say the following: in accordance with part 4 of article 49 of the Criminal Procedure Code of the Russian Federation, the lawyer is allowed to participate in a criminal case as a defense attorney on presenting an attorney ID and order. Administration of the pre0trial facility does not make decision on allowing a lawyer to participate in a criminal case. According to requirements of Criminal Procedure Code of the Russian Federation the same person cannot be defense attorney to both suspect and accused if interests of one of them contradict interest of the other. Moreover a defense attorney has no right to participate in criminal proceedings if he is currently or earlier rendered legal assistance to a person whose interests contradict interests of the suspect or accused he is currently defending. The lawyer Volkova in the said criminal proceedings is defending interests of suspect S. Udaltsov and accused K. Lebedev. Taking into account the materials in the case the interests of the accused Razvozzhayev contradict those of mentioned persons. The investigators have accordingly issued a challenge order for defense attorney Volkova which has been sent to her in due manner.
