In Sverdlovsk Region former Chief of Verkhnaya Pyshma Department of Internal Affairs charged with negligence in connection with events in the village of Sagra and with abuse of official powers

Sverdlovsk Region investigating bodies of the Russia’s Investigative Committee have completed investigating a criminal case against Marat Khalimov, 48, charged with crimes under part 1 of article 293 (negligence) and part 1 of article 285 of the RF Criminal Code (abuse of official powers).

According to investigators, on 2 August 2004, when Khalimov was Chief of Verkhnaya Pyshma Department of Internal Affairs, the local authorities gave local police station for free use a Volkswagen Passat. Later it was found that the car as early as in September 2001 was federally wanted in a criminal case initiated by Ingush customs of the Federal Customs Service. Chief of the city Traffic Police Department informed Khalimov about it in the period between 2007 and February 2008. However, despite the ban to use this car, Khalimov in the period between Nay 2008 and January 2011 issued a number of orders by which he assigned the car for himself and his drivers making it look like being legal. In the period between April 2008 and June 2011 he continued using the car not having taking the state registration signs for their utilization due to annulment of registration of the car as being wanted. Khalimov’s actions entailed considerable violations of interests of society and state protected by the law, which were reflected by undermining the reputation of internal affairs bodies not only in the eyes of ordinary people, but employees of the Verkhnaya Pyshma Department of Internal Affairs subordinate to Khalimov. In addition the car was used without general inspection which posed threat to traffic safety including lives and health of people.

Khalimov is also accused of the fact that in the period when he was Chief of Verkhnaya Pyshma Department of Internal Affairs he actually withdrew from controlling observation of discipline by his subordinates. Khalimov’s inaction reflected in his not taking necessary organizational and staff measures to eliminate the violations revealed in the activity of the district police operatives department of Verkhnaya Pyshma Department of Internal Affairs, led to considerable violations of interests of society and state protected by the law, which were reflected discredit to and undermining of reputation of law enforcement represented by Verkhnaya Pyshma Department of Internal Affairs and trust to law enforcement by the people of Sagra village. Particularly, investigators believe that this culpable negligence ended up by the fact that Vadim Zayniyev, who was in summer 2011 senior district operative of Department of Internal Affairs for Verkhnaya Pyshma and Sredneuralsk city districts due to lack of due control from the chief of the public security police of the said police department Sergey Zinovyev unduly performed his duties to check by Sagra people rules for registration and for storage of firearms in the territory of the village. As a result, a local man, who had been wanted since 1995 for a serious offence and who was one of the organizers of mass disorders in the village, had a chance of living illegally in the village during a long period of time using a fake passport. Another man had an opportunity to store in his basement in Sagra village a 16 caliber sawn-off rifle and at least 4 cartridges to it, which were used in the said disorders. Investigators have also found out that Zayniyev had information that some people, who had come from Yekaterinburg, on 30 June 2011, threatened to murder a local teenager and that in this connection there was a meeting arranged on 1 July 2011 between locals and those came from Yekaterinburg with possible use of violence and firearms. He was informed about that on the phone by a local man. However, Zayniyev concealed this information from his inferiors and did nothing to check it. After that Zayniyev on his own, not informing his inferiors left the Sverdlovsk Region for his parents’ in Bashkortostan to spend the weekend there. Khalimov has not pleaded guilty.

Investigators have collected enough evidence and the case after the copy of the approved indictment is given to the accused, will be sent to the court to be tried on the merits.
