Men involved in murders of judges in Makhachkala identified

The investigating bodies of the Russia’s Investigative Committee in North-Caucasus Federal District are investigating a number of criminal cases launched in sings of crimes under article 295 of the RF Penal Code (encroachment on a life of a judge), part 2 of article 222 (illegal circulation of firearms by a group of people) and paragraphs “f” and “h” of part 2 of article 105 (murder committed by generally dangerous way) over facts of encroachment on the life of judge of Dagestan Supreme Court Mukhtar Magomedov, judge of federal court of Leninsky district in the city of Makhachkala in Dagestan Zeynudin Madanov, judge of Dagestan Supreme Court Magomedmukhtar Shapiyev and his son Kamil Shapiyev. All these criminal cases have been filed in a single law suit.

After a number of audacious attacks on police forces Ruslan Kazanbiyev was killed during a special operation carried out by personnel of the local office of the Federal Security Service and Interior Ministry on 19 November in Kirov region in Makhachkala, and leader of Makhachkalinskaya gang Murad Kasumov and its member Kamil Muslimov were killed on 20 November.

According to investigators, on 15 January Sirazhudin Guchuchaliyev, Murad Kasumov and Ruslan Darsamov waited for judge of Dagestan Supreme Court Mukhtar Magomedov to leave his house in Makhachkala, and Guchuchaliyev shot three times into his head from Stechkin pistol. At the same moment Kasumov pushed into the gates the judge’s wife, who had tried to run away. Darsamov searched the judge, and Guchuchaliyev shot two more times in his head and chest, after that all of them fled the scene. As a result of his wounds Mukhtar Magomedov died on the spot. Involvement of Guchuchaliyev, Kasumov and Darsamov in the judge’s murder is confirmed by the conclusions of ballistics, traceological-chemical and DNA tests, reports on identification of the gang members recorded by CCTV cameras, identification reports by two taxi drivers, who were attacked by the gang members on the day when they murdered the judge to get their cars, as well as by Guchuchaliyev’s confess, who offered active armed resistance during the arrest and was wounded.

Besides, the preliminary investigation has found that Kazanbiyev, who was killed during the special operation, had been involved in the 25 September murder of judge of Dagestan Supreme Court Magomedmukhtar Shapiyev and his son. A witness of the murder was found and questioned, he pointed the distinctive marks of the murderers. It was he who recognized Kazanbiyev on the photo.

During the investigation of the murder of judge Zeynudin Madanov it has been found that on 4 November two unidentified persons waited for the judge to leave his house and presumably using two Stechkin pistols with Makarov pistol 9mm bullets shot multiple times at him. As a result of his wounds the man died on the spot. The criminals fled the scene.

17 cartridge cases and 3 bullets of 9mm Makarov pistol were seized from the crime scene and sent for a ballistic expert examination and a DNA test of swabs from the cartridge cases, commissioned to the experts of the Main Investigations Directorate in the North Caucasus Federal District. A number of other expert examinations were assigned to consolidate the evidence and find all the circumstances of the crime.

Investigators have found a witness, who told about the circumstances of the crime and gave distinctive marks of one of the attackers.

The eyewitness has recognized Magomedov as having been one of the men who shot. Magomedov is wanted.

The results of the analyses show that 10 out of 17 cartridge cases, seized from the scene of murder of Zeynudin Madanov, and 9 out of 18 cartridge cases, seized from the scene of murder of Magovedmukhtar Shapiyev were shot from one firearm, which means that both killers were from one gang.

A Stechkin pistol was found on 20 November 2013 next to Kazanbiyev’s body after the special operation. The firearm was then checked in bullet and shell casing repository and it was found that it was the pistol from which judge Shapiyev had been shot.

Investigation is ongoing.
