Persons damaging state over 35 million rubles convicted in Trans-Baikal Territory

The court has found the evidence gathered by Chita garrison military investigations department of the Russia’s Investigative Committee enough to convict former head of clothing and ration rear service of the military unit 32390 major Dmitry Petrov and Major in reserve khachatur Oganesyan, who was before subordinate to the commander of the military unit 11387. Petrov was found guilty of crimes under part 4 of article 159 of the RF Penal Code (fraud on an especially massive scale) and part 2 of article 292 (forgery committed by an official and entailing considerable violation of the state rights protected by law), Oganesyan – part 4 of article 159.

The court and investigators have found that to execute the state contracts, agreements were concluded with OOO MTTs (LLC) on organizing meals for personnel of the military service 32390. Petrov gave to the unit commander delivery and acceptance certificates containing real information on the work done. But further on, he abused his commander’s trust and gave him for sealing forged acts containing overstated rates of work done, which he signed himself. Then the officer gave the forged documents to the regional manager of OOO MTTs (due to the fact that he is federally wanted, the criminal case against him has been severed into separate law suit), who then submitted them to the finance bodies of the Defense Ministry for payment.

The specialists estimate that as a result of Petrov’s actions, who received for that from officials of OOO MTTs over 900 thousand rubles, the Russian Ministry of Defense during 2011-2012 paid to the commercial organization about 30 million rubles for not executed work. In addition, during several months Major Oganesyan took part in providing forged delivery and acceptance certificates to the Defense Ministry. The court and investigators have found that as a result of Oganesyan’s actions the Ministry paid another 5 million rubles to the company for not executed work.

The court sentenced Petrov and Oganesyan to 7 and 5 years respectively in settlement penal colony and minimum-security penal colony and a fine of 1 million rubles and 500 thousand rubles respectively. In addition, the court banned Petrov for three years from occupying positions in state and local governments connected with storage, registration and disposal of the funds. The action to exact from the convicts over 35 million rubles will be tried by civil trial.
