In Trans-Baikal Territory leader of “black realtors” gang gets 24 years in jail

A court has recognized the evidence gathered by Trans-Baikal Territory investigating bodies of the Russia’s Investigative Committee sufficient to convict Nikolai Borisenko. He was found guilty of fraud committed by an organized group for the purpose of hiding another crime, attempted murder of two people by an organized group for the purpose of hiding another crime, deliberate use of a forged document and illegal crossing of Russian border (part 4 of article 159, part 3 of article 30, part 4 of article 159, part 2 of article 330, part 2 of article 291, paragraphs “g” and “j” of part 2 of article 105, part 3 of article 30, paragraphs “a”, “g” and “j” of part 2 of article 105, part 3 of article 327, part 1 of article 322 of the RF Penal Code).

The court and investigators have revealed that in 2009, Borisenko headed an organized criminal group, which included nine more people, including a director of a real estate firm, two employees of the regional office of the State Registration Service and a passport registering clerk of Mogzon village administration, Khilok District, Trans-Baikal Territory. In the period between November 2009 and May 2010, the criminal group performed fraudulent operations against three residents of the town of Chita and Khilok District, whose flats were illegally alienated, registered on the names of other people and sold. One of the former owners was killed and the other one was reported missing. In addition, members of the criminal group committed a forcible assertion of will against a family, which they illegally evicted. To organize illegal registration of the stolen flats, Borisenko gave bribes through intermediaries to an employee of the Trans-Baikal Office of the Federal Service for State Registration, Cadaster and Cartography. Fearing that he would be caught, in May 2010 Borisenko organized the murder of the passport registering clerk and the intermediary, who was saved thanks to timely medical aid. Borisenko and Anatoly Zinin, 43, the killer, hid from police for a long time. Zinin was held in May 2012. Borisenko was caught in February 2013, trying to illegally cross the border between Russia and Kazakhstan. When he was held, he showed a forged passport.

The court has sentenced Borisenko to 24 years to be served in a maximum-security penal colony, and a fine of 700 thousand rubles. The criminal cases against each member of the criminal group were considered by the court earlier. In April 2013, Zinin was sentenced to 23 years in jail, the rest of the members got between 3 and 7 years to be served in a minimum-security penal colony, and fines between 80 and 300 thousand rubles.
