In Moscow Region investigation launched in unsafe services entailing grievous bodily harm to child in preschool education facility

On 12 March 2015, a 5-year-old boy preliminarily diagnosed with skull base fracture suffered in an incident in the kindergarten was delivered to a hospital in the town of Vidnoye. The investigating bodies of Moscow Main Investigations Directorate of the Russia’s Investigative Committee have launched a criminal investigation in a crime under paragraphs “b” and “c” of part 2 of article 238 of the RF Penal Code (administration of unsafe services entailing grievous bodily harm to a child).

According to investigators, on 12 March 2015, in the afternoon the 5-year-old boy was badly injured while swinging on the swings in the kindergarten in the town of Vidnoye. With no proper control of the teacher the boy tried to get off the swings and was hit by the seat in the head.

Involving a specialist of the Construction Surveillance Department investigators have examined the incident site and the swings the child fell off from. It was revealed that the swings were not in compliance with the State Standards as there was no bar across the front side of the swings which the child could hold on to. This way the swings are dangerous because the child can easily fall off them.

A forensic medical examination has been assigned. The investigators have questioned the staff of the facility, confiscated necessary documents, the swings and have assigned a technical examination to check if the swings were in compliance with the State Standards. Job descriptions have been requested and received. The investigation is ongoing.
