Sentence passed in Moscow for stealing state funds for purchasing CT scan for Russian Ilizarov Scientific Center for Restorative traumatology and Orthopedics

The court has recognized the evidence collected by the Kurgan Region investigating bodies of the Russia’s Investigative Committee sufficient to convict a former chief specialist expert of high tech medical aid development department of the Russian Ministry of Public Health and Social Development, Ilya Kasyanenko, former Deputy CEO of Russian Ilizarov Scientific Center for Restorative traumatology and Orthopedics (hereinafter Ilizarov Center), Alexander Fedotov and an unemployed Moscow citizen Igor Plakhotnikov. Depending on the role of each one they were found guilty of crimes under part 3 of article 285, part 4 of article 33, part 3 of article 285 of the RF Criminal Code (abuse of official powers and instigation to it) and part 4 of article 159 (swindling committed by a group of persons under a preliminary conspiracy).

Investigation and court have found that in 2008 Kasyanenko was responsible for implementing a plan for distributing allocations of federal budget in 2009, meant for development of new medical high technologies. He promised Fedotov his assistance in including the medical center, where he was a top manager, in the list of recipients of budget funds for purchasing high-tech medical equipment. Kasyanov in the interests of the commercial organization demanded to purchase for Ilizarov Center a CT scanner of a certain manufacturer. In 2009, Fedotov fulfilling Kasyanenko’s instruction organized an open bidding for purchasing a CT scanner in such a way that there was only one participant – an official dealer of manufacturing firm mentioned by Kasyanenko. Later a government contract worth 92 million 150 thousand rubles which is twice as much as a market price of a CT scanner was concluded with this firm. As a result of Fedotov actions instigated by Kasyanenko the federal budget suffered a loss of more than 46 million rubles.

In addition, in late 2009, kasyanenko, acting through his acquaintance Igor Plakhotnikov, who acted as an intermediary, after the money was transferred to the account of the firm which supplied the CT scanner, demanded from its CEO to give him 15% of the government contract sum. Otherwise Kasyanenko threatened to take measures to stop business of the firm. Fearing unlawful actions on the part of the official of the Russian Ministry of Public Health and Social Development, the victim gave the accomplices 13 million 800 thousand rubles.

During the investigation Kasyanenko and Plakhotnikov were put into custody. The case was investigated by department for investigating especially important cases of the Kurgan Region Investigations Directorate of the Investigative Committee in cooperation with Economic Security and Anti-Corruption Main Office of the Russia’s Ministry of Internal Affairs and the Kurgan Region Directorate of the Russia’s Ministry of Internal Affairs.

Following the results of the investigation a paper was sent to Russian Ilizarov Scientific Center for Restorative traumatology and Orthopedics statin necessity to eliminate circumstances contributing to the crime. The paper states the necessity to eliminate mistakes made by the top management of the Center when organizing and purchasing for government needs. Besides, damage of 22 million rubles was repaid during the investigation.

The court sentenced Kasyanenko to 6 years in a minimum-security correctional facility. Igor Plakhotnikov was sentenced to 4 years in in a minimum-security correctional facility. Alexander Fedotov got a suspended sentence of 4 years in prison. In addition, the court satisfied actions to recover 46 million jointly from the convicted on account of repaying government damages. The action of CEO of the commercial firm on recovering 13 million 800 thousand rubles from Kasyanenko and Plakhotnikov was also satisfied.
