Investigation against mayor of Berdsk in Novosibirsk Region and his first deputy finished

The Novosibirsk Region investigating bodies of the Russia’s Investigative Committee have finished investigating a criminal case against mayor of Berdsk, a town in Novosibirsk Region, Ilya Potapov and his first deputy Vladimir Mukhamedov. Potapov is charged with 3 counts of crimes under part 3 of article 30, part 6 of article 290 (attempted bribery on an especially massive scale), part 6 of article 290 (bribery), part 3 of article 30, part 4 of article 159 (attempted fraud on an especially massive scale), part 2 of article 285 of the RF Penal Code (abuse of official powers by a state official), Mukhamedov – with 4 counts of the crimes under part 4 of article 291.1 (mediation in bribery on an especially massive scale), part 3 of article 30, part 4 of article 159 of the RF Penal Code (attempted fraud on an especially massive scale).

According to investigators, on 30 April 2013, the official was detained by operative agents after receiving a bribe of 3 million rubles from a representative of a commercial organization for providing a piece of land for building in an elite area on the coast of the Berdsk Bay. Investigators also found that between January and April 2013 mayor of the town with his deputy as intermediary agreed to receive 3 bribes worth total 12 million rubles from a representative of a commercial firm. The accused were going to take the money for providing pieces of land to the firm in ownership, in one case the accused received a part of the bribe of 3 million rubles.

In addition, between 30 January and 2 December 2013 Patapov’s illegal actions entailed considerable violation of rights and legal interests of Berdsk causing damage because of deficiency of about 24 million rubles from renting out and selling lands in the town.

It was also established that in 2011 Mukhamedov and Potapov due to their positions had information that a legal person won an auction on the right to conclude a municipal contract with Housing and Communal Services Office, a municipal facility, on maintaining the streets of the town and that the facility has about 14 million rubles in debts under earlier contracts. The officials decided to get by deceit the right on another’s property, namely chose in action to the municipal facility. To do that they offered the CEO of the firm give up the chose in action to the facility, promising in exchange to conclude the municipal contract. However, in fact they did not have any right to conclude such a contract.

During investigator the investigators have interviewed over 30 witnesses and run over 10 forensic expert examinations. The case has 27 volumes.

Investigators have gathered enough evidence, therefore the case has been sent for the indictment to be approved and further on to court to be tried on the merits.
