Request of Russia’s Investigative Committee Chairman to launch criminal case against Krasnodar Territory Arbitration Court judge Sergey Rusov granted

The Higher Judges’ Qualification Board of the Russian Federation granted the request of the Chairman of the Investigative Committee of the Russian Federation for the consent to institute criminal proceedings against the judge of the Arbitration Court of the Krasnodar Territory Sergey Rusov.

We remind that the grounds for this submission were the results of preliminary check conducted by the Investigative Committee of the Russian Federation for the Krasnodar Territory into the illegal receipt of funds by the judge of the Arbitration Court of the Krasnodar Territory Sergey Rusov, that is a crime under Part 6 of Article 290 of the Criminal Code (bribery).

According to the materials of the procedural check, the judge was considering the action of Sochi administration on recovery of penalty from a construction company. In October 2012 Rusov invited to his office a representative of a defendant, and offered him to give him 20 million rubles for ruling in favor of the construction company. The representative of the defendant agreed to the offer, but reported it to the Krasnodar Territory Investigations Directorate. Later the representative of the defendant twice met with the judge in his office and gave him the necessary sum. After the final receiving of the money the judge’s actions were stopped by operative agents of the Krasnodar territory Directorate of the Federal Security Service, who acted on the instructions of the investigators.

After the decision of the Higher Judges’ Qualification Board of the Russian Federation come into force, the Chairman of the Investigative Committee will decide on launching a criminal case against Sergey Rusov.
