Criminal proceeding started in Rostov-on-Don over death of child delivered to hospital with acute purulent meningoencephalitis

A small child from day nursery was delivered in a hospital with diagnosis “acute purulent meningoencephalitis” on 2 June 2013 and died a few hours later. Investigating bodies of the Russia’s Investigative Committee in Rostov Region have launched a criminal investigation into a crime under part 2 of article 109 of the RF Criminal Code (reckless homicide due to improper discharge by a person of their professional duties).

Investigators have information that pediatricians and paramedics arrived to examine the sick child several times, but did not provide adequate medical help. Only after mother insisted her child was delivered to the hospital where he died.

In addition regional investigating bodies carry on investigating a criminal case against director of the kindergarten suspected of a crime under part 2 of article 293 of the RF Criminal Code (negligence).

During the probe investigators are going to check how adequately were discharged the duties by officials of education bodies, Federal Service of Supervision over Protection of Consumers’ Rights and Human Wellbeing and medical facilities which serviced the kindergarten and are going to give legal treatment of provision of and control over medical and preventive help to children and timely declaration of anti-epidemiological regime. Actions of the leadership of the kindergarten as of formation and adequate number of children in the groups won’t stay unattended. Though legal treatment will be given not only to the actions of the staff of kindergarten, but to doctors who performed the first examinations on some of the children, but failed to diagnose the disease, whose symptoms are too specific and well-recognizable and did not take measures to hospitalize the sick and prevent the spread of the disease. Timeliness and adequacy of their actions, their professionalism, which already raise questions in the investigators, will be studied by forensic experts.

The investigation is under personal control of the leadership of the Russia’s Investigative Committee. Protection of underage citizens of the Russian Federation is an object of constant and close attention and a permanent principle in the work of the Committee.
