In Moscow sentence passed over OAO Oboronservis case

A court has recognized the evidence gathered by the Main Military Investigations Directorate of the Russia’s Investigative Committee sufficient to convict former CEO of OOO Legal Support Center Expert (hereinafter the Expert Center; later renamed into OOO Legal Center and them to OOO Mira) Dinara Bilyalova. She was found guilty of a crime under part 4 of article 159 of the RF Penal Code (fraud on an especially massive scale).

The court and investigators have found that OAO Main Troops Provision Office, incorporated in OAO Oboronservis and the Expert Center had an agency contract, under which the latter undertook to carry out operations to sell assets of the affiliates of the Main Troops Provision Office. Though the Expert Center did not actually provide any agency services, over a year and a half over 123.5 million rubles was transferred to the accounts of the company as an agency fee, which then was stolen.

During the initial investigation Bilyalova fully admitted her guilt, concluded a pre-trial cooperation deal, assisted the investigation, identification and prosecution of other individuals involved in the crime, and started compensating the damage made by the crime.

Moscow Tagansky district court sentenced Bilyalova to 4 years in a minimum-security penal colony and a fine of 800 thousand rubles. In addition the court banned her from taking any positions in state service or local governments connected with distribution of funds of the federal or local budgets.

It should be noted that despite numerous public allegations made by the individuals under the Oboronservis investigation that there is no corpus delicti in their actions, the accused pleaded guilty and moreover gave exhaustive and truthful testimonies including against her chief accomplice Yevgenia Vasilyeva. As for the sentence, to all appearance, the court has taken in consideration Bilyalova’s wish to cooperate and her assistance in identifying the crimes of her accomplices. Individuals, who make pre-trail cooperation deals and assisting the investigation, have the right to more lenient sentence of no more than two thirds of the maximum prison term provided by the RF Penal Code for this or that crime. The sentence to Bilyalova confirms the completeness of the evidence gathered by the investigators proving a multi-count crime committed in conspiracy with other accomplices, which were 6 people, excluding Bilyalova, led by Vasilyeva. But they did not admit their guilt and should not expect the court to be so gracious or lenient.
