In Omsk resident of Cherlak District convicted for rape and murder of two small children

A court has found the evidence gathered by the investigating bodies of the Russia’s Investigative Committee for the Omsk Region sufficient to convict 40-year-old Maxim Kalinin. He was found guilty of crimes under part 1 of article 222 of the RF Penal Code (illegal circulation of firearms), paragraph “b” of part 4 of article 131 (rape of a victim under 14 years of age), paragraphs “a”, “c”, “e” and “j” of part 2 of article 105 (murder of two small children with special cruelty, aggravated by a rape, to conceal another crime).

The court and investigators found that on 29 June 2011, about 7 PM, in the village of Bolshoy Atmas, Cherlak District of the Omsk Region Kalinin while being under a suspended sentence, was drunk and raped a 9-year-old daughter of his acquaintances. After that the accused trying to conceal the traces of the crime took the girl to an outhouse, tied her up and left there for 2 hours, while her parents came in Kalinin’s house and asked about their daughter. Then Kalining fearing to be caught strangled the girl and buried the body in a gutter in his yard and burned her clothes.

In addition, on 3 October 2013, about 9 PM, drunken Kalinin demanded from his 7-year-old son to read him aloud. When the boy started faltering, he beat him up severely, delivering no fewer than 30 blows to his head and body, causing a brain injury and a closed injury to his stomach rupturing his internals. The boy died from the injuries several hours later. Having realized that the child was dead, Kalinin wrapped his son’s body in a piece of polyethylene, took it to a dump and heaped rubbish over it. He also burned the boy’s blood-covered clothes, school uniform, bag and books trying to make it look like the child got missing. The next morning, he intimidated his wife and sent her to school to claim that she was looking for her son. During several days Kalinin and the boy’s mother took part in search operations organized by investigators.

However, Kalinin failed to avoid criminal liability, as during investigating operations, including the ones using a lie detector, the investigators found that he was involved not only in killing his own son, but in the murder of the 9-year-old girl. Under the load of evidence Kalinin confessed to the crimes and showed the places where he buried the bodies. During the examination of burial sites the investigators found and dug up the remains of the victims, and other material evidence to run forensic medical, DNA and biological tests. Besides, they confiscated from Kalinin a sawn-off hunting rifle Izh-18-E fit for shooting, which he had found on the attic and kept since then. During the investigation Kalinin was placed in custody pending the trial.

It was established that Kalinin had 6 more previous records for thefts and robberies and for failing to discharge his duty in raising his small son from his first marriage.

During the investigation the accused several times changed his testimonies, suggesting different versions, including the one that it was his wife who killed his son, however, all his allegations were disproved by the evidence collected by the investigators. Kalinin also claimed that his wife about his crimes, but kept it back fearing to be killed. During the investigation the woman gave detailed testimony incriminating her husband.

The court has sentenced Kalinin to life in a special penal colony and 2 years of confinement.
