In Arkhangelsk criminal case against former and current deputies charged with attempted fraud and deliberate bankruptcy of company finished

The investigating bodies of the Russia’s Investigative Committee for the Arkhangelsk Region and Nenets Autonomous Area have finished investigating a criminal case against former deputy of the City Duma Vitaly Graf and his accomplice – deputy of the Arkhangelsk Region Assembly of Deputies Sergey Myshkovsky, charged with crimes under article 196 of the RF Penal Code (premeditated bankruptcy), part 3 of article 30, part 4 of article 159 (attempted fraud by a group of people in a previous concert on an especially large scale including using official position).

According to investigators, General Director of OAO Northern Timber Processing Partnership – Timber mill No 3 (hereinafter the Timber mill No 3) Vitaly Graf in June 2012 conspired with Myshkovsky to steal the assets of the mill by setting up an artificial bill payable to companies affiliated to Myshkovsky with the purpose of bankrupting the Timber mill No 3 and selling its main assets. Not having any intention to pay the mill’s debts, the accused deliberately committed actions to sell its assets on knowingly unprofitable for the Timeber mill No 3 conditions, which affected the mill’s ability to pay its debts. In addition, without immediate necessity, the leadership of the mill concluded a number of deals on unprofitable for the mill terms, making the total sum of bills payable at least 500 million rubles. Those actions caused the mill’s bankruptcy.

However, their intention to steal the assets of the Timber mil No 3 worth at least 500 million rubles, which they intended to get during the procedure of bankruptcy from selling its main assets, was not complete on the reasons independent of their will.

The criminal case was opened based on the files provided by the regional office of the Federal Security Service and the Economic Safety and Counter Corruption Department of the Arkhangelsk Region Office of the Russian Interior Ministry.

The investigators have gathered enough evidence, therefore, the criminal case with the approved indictment has been sent to court to be tried on the merits.
