Investigative Committee sends files over check on deputy Alexander Khinshtein plane incident to Prosecutor General’s Office

Recently media have published reports on wrongdoings of the State Duma deputies Alexander Khinshtein and Vadim Bulavinov aboard planes. Considering the fact that the deputies of the supreme legislation body of the country have special legal status, the checks into the facts have been organized by Moscow Interregional Transport Investigations Directorate of the Russia’s Investigative Committee.

Judging by the data obtained during the check, on 29 May 2014, deputy Khinshtein was on a flight from Mineralnye Vody to Moscow and grossly violated the requirements of the Air Code of the Russian Federation and the Passenger Code of Conduct. Namely, the deputy prevented a flight attendant from performing his professional duties, ignored not only oral warnings made by the flight attendant, but a written warning by the commander of the aircraft on the provision of air security. In addition, according to the check materials, Khinshtein used offences against a flight attendant and two passengers humiliating human dignity. All the violations of public order by the deputy were reported to the terrain services and the police by the crew.

Due to lack of felony in Khinshtein’s behavior, the criminal case against him has been denied. However, it is apparent that such disorderly behavior contains signs of administrative infractions under part 6 of article 11.17 and article 20.1 of the RF Administrative Violations Code (failure by a person aboard an aircraft to meet lawful requirements of the captain plus disorderly conduct). Considering that the decision to open a case against the State Duma deputy into an administrative infraction can be made on the consent of the State Duma obtained based on the application of the Prosecutor General’s Office, the corresponding documents have been forwarded to the Prosecutor General’s Office to decide on stripping the deputy of his inviolability and on prosecuting him for the administrative infraction.

The Investigative Committee is continuing the check into an incident involving deputy Bulavinov happened aboard an aircraft on 16 June. An adequate procedural decision will be made following the check.
