In Surgut businessman to stand trial for unsafe services entailing death of child in Filin water park

Khanty-Mansi Autonomous Area – Yugra investigating bodies of the Russia’s Investigative Committee have finished investigating a criminal case against the owner of the Filin water park from Surgut. He is charged with a crime under paragraph “c” of part 2 of article 238 of the RF Penal Code (execution of work or delivering services that do not meet life or health safety standards of consumers involving death of a person by negligence).

On 26 March 2015, the 8-year-old boy accompanied by his mother’s acquaintance was in the Filin water park in the village of Finsky, Surgut. At the moment when the woman went away from the swimming pool to the café to get some food for the boy, the child, who could not swim and had no life jacket on, got into a swimming pool between 100 and 140 cm deep designed for children aged between 9 and 15 and drowned.

In addition, on 27 April 2014, a 9-year-old boy went to the deep part of the pool in the same water park and started to drown. His father saw that and rescued him. The boy stayed alive.

After having confiscated and studied the documents of the facility, the investigators revealed that violating the current legislation the businessman had failed to provide the facility with the staff responsible for the safety of adults and children while they were in the pool, to organize the duty of instructions and medical personnel able to provide medical aid in water. As a result the conditions of the services provided in the water park did not meet life and health safety standards. The court ruled to suspend the services.

The investigators have fathered enough evidence so the criminal case has been sent to court to be tried on the merits.
