Four to stand trial for series of crimes in Makhachkala

The North Caucasian Federal District Main Investigations Directorate of the Russia’s Investigative Committee has finished investigation against former criminal investigator of the Investigations Directorate for Dagestan Arskana Kurbanaliyev and officers of Makhachkala office of the Russian Ministry of the Interior Mukhtar Magomedov, Arsanali Magomedov and Fikter Saidov and Kurbanaliyev’s acquaintances Gazan Temirsultanov and Kurban Magomedov. Depending on the role of each one they are charged with crimes under paragraphs “a” and “b” of part 3 of article 286 of the RF Penal Code (abuse of power using force and threat to use force and using arms) and paragraphs “a”, “c” “d” and “g” of part 2 of article 127 (illegal deprivation of freedom), part 4 of article 159 (fraud), part 3 of article 30, part 4 of article 159 (attempted fraud committed by a group of people, a person using their official position on a grand scale and not completed because of outer reasons).

According to investigators, in March 2013, in Makhachkala, Kurbanaliyev together with police officers Mukhtar Magomedov, Arsanali Magomedov, Fikter Saidov and Makhach Magomedov were having an argument about a flat between his relative and Patimat Ibragimova and beat the latter and her son Ibragim Magomedov. After that they tied them up and forced in a police cruiser, where they held them demanding that they refused their claims on the flat.

In addition, in the period between 2011 and 2014, Kurbanaliyev used his position and conspired with Temirsultanov to steal over 7 million rubles by fraud from three residents of Dagestan. He got the money under the pretext of assisting in changing a restraint and stopping prosecution, the actions he could not and did not intend to do. In April 2015, Kurbanaliyev together with Jurban Magomedov attempted a similar crime by stealing money for assisting in making conditions in custody better.

The investigators have enough evidence, so the criminal case with the approved indictment has been sent to court to be tried on the merits.

As accused Makhach Magomedov and Kurban Magomedov are hiding from investigation, they are wanted and cases against them were severed to form a separate lawsuit.

I would like to note that the Russia’s Investigative Committee has always responded quickly and rigidly to each fact when one of its ranks has broken the law, independent of ranks, positions and former services. This is a principled position of the senior officials of the Investigative Committee which gives us not only legal but moral right to respond as rigidly to any crimes, including those committed by officers of other law-enforcement bodies.
