The IC of Russia Transfers 10 Criminal Cases on the Crimes Committed by the Kiev Regime Against the Civilian Population to the Prosecutor’s Offices of the DPR and LPR

In line with the norms of national and international law, which provide for the obligation of states to search for and prosecute persons involved in the violation of the Geneva Conventions of 1949 and Additional Protocols I and II to them of 1977, the Investigative Committee of Russia is investigating the criminal actions of Ukrainian military personnel against civilians in Donbass.

In accordance with the agreements concluded between the Investigative Committee of the Russian Federation and the Prosecutor’s Offices of the Donetsk and Lugansk People’s Republics, as well as the rules of territorial jurisdiction, in order to more fully investigate the circumstances and take into account local features, 10 criminal cases have now been transferred to the Prosecutor’s Offices of the republics for further referral to the court. These include a criminal case against Vasily Shitrya, a soldier of the 23rd separate motorized infantry battalion of the Armed Forces of Ukraine, who in April 2022, while in the building of a post office in the city of Mariupol, fired at least 20 aimed shots from a machine gun at passing-by civilians. Two men and two women died at the scene from their injuries.

Also, a criminal case against the military personnel of the 36th Separate Marine Brigade of the Armed Forces of Ukraine Anatoly Perets and Serhiy Pilipovich has been transferred for further referral to the court. In February 2022, these servicemen, while in the area of the Ilyich Iron and Steel Works in the city of Mariupol, fired multiple aimed shots from a machine gun at three civilians. The victims died at the scene of the crime from the gunshot wounds they received.

Also, a criminal case against a soldier of the 36th Marine Brigade of the Armed Forces of Ukraine Nazariy Moroz has been transferred to the Prosecutor General’s Office of the DPR. On March 30, 2022, Nazariy Moroz fired multiple aimed shots from a machine gun at a car that belonged to civilians passing along the street in the city of Mariupol. A family of three was in the car: the couple and their adult son. As a result of the shelling, the woman suffered gunshot wounds, from which she died at the scene of the crime, one man was wounded, and the second managed to escape death.

A criminal case against a serviceman of military unit A-3814 of the Armed Forces of Ukraine, senior driver, senior soldier Ruslan Maystruk has been transferred to the General Prosecutor’s Office of the LPR. In February 2022, in order to mine a road bridge across the Derkul River in the settlement of Gorodishche, the Lugansk People’s Republic, Ruslan Maystruk tried to deliver 10 cumulative charges containing a total of about 500 kg of explosives. The explosion was supposed to be carried out remotely during the passage of the Russian military convoy and the civilian population across the bridge. This plan failed as the Russian military command took preventive measures.

A criminal case against senior lieutenant Serhiy Paliychuk, the commander of the first self-propelled artillery battery of the second self-propelled artillery battalion of the military unit A-3283 (the 17th separate tank brigade) has been completed and transferred to the Prosecutor General’s Office of the DPR. In February 2022, Serhiy Paliychuk repeatedly gave orders to his subordinate military personnel to shell residential buildings and socially significant objects of civilian infrastructure from Akatsiya self-propelled artillery guns. As a result of these criminal actions, a child died, a woman received a brain contusion. In addition, residential buildings and facilities were damaged.

The investigation collected a sufficient evidence base, the materials of the criminal cases have been transferred for further referral to the court and consideration on the merits.
