In Kirov Region number of investigative operations carried out in case over ice mound falling on baby

Kirov Region investigating bodies of the Russia’s Investigative Committee continue investigating a criminal case opened over bodily harm inflicted to a baby by a mound of ice and snow that fell on him from the roof of a 5-story building (paragraph “c” of part 2 of article 238 of the RF Penal Code – doing work or providing services that do not meet life and health standards that entailed death of a person by negligence).

In the afternoon of 13 February 2015, a mound of ice fell from the roof of a 5-storey house in Shironintsev street in the town of Kirov on a baby pram with a 1-month-old baby inside. An emergency team took him to a hospital with a closed brain injury, multiple fatal injuries to head and body. The doctors did their best, but could not resuscitate the baby and he died at night of 14 February 2015.

A number of investigative operations have been carried out and namely: they investigators examined the incident scene, questioned the house tenants and confiscated documents from the office of facility manager OOO Lepse-uyut. According to the schedule, the cleaning of the roof from snow was planned on 11 February and there are execution certificates. However, during the examination of the scene investigators saw that there were mounds of ice and snow on the roof that could have threatening lives of the citizens walking down the pavement. The tenants of the house also confirmed this information.

The preliminary information provided by the officials of the city administration office that the ice mound fell from a balcony on the fifth floor was not confirmed during the investigation of the scene. The investigators ran an experiment and found out that the mound of ice weighing about 9 kg fell from the roof and not from the balcony. The house is serviced by facility manager OOO Lepse-uyut. At the moment of the incident the master was on a sick leave, and the CEO of the company was responsible for organization and execution of work connected with clearing the roofs of houses from ice and snow.

The CEO of the company has been detained. At present the investigators are preparing a request to place him in custody pending trial.

Investigative operations are underway to gather and consolidate the evidence. The investigation is ongoing.
